Welcome to SEA Connections! By accessing and using our services, you agree to the following Terms and Conditions ("T&C"). Please read them carefully.

1. Acceptance of Terms

By accepting our services, requesting a quote, or entering into a contract with SEA Connections, you agree to be bound by these Terms and Conditions and any additional terms presented at the time of service. If you do not agree with these T&C, you must refrain from using our services.

2. Scope of Work

SEA Connections provides solar, electrical and air conditioning installation services as outlined in the project proposal or contract. We will carry out the work with due care and skill and in compliance with relevant Australian laws and safety standards.

3. Payment Terms

All payments for services rendered are due as per the payment schedule outlined in the contract. Payments must be made in full within the agreed period after the completion of work unless otherwise specified.

Late Payments: If payment is not received by the due date, SEA Connections reserves the right to charge interest on the overdue amount at a rate of 10% per annum, compounded monthly, until the outstanding balance is paid in full.

Non-Payment: In the event of non-payment, SEA Connections reserves the right to remove any products or equipment installed as part of the service (including, but not limited to, solar panels, inverters, batteries, air conditioners or other electrical components). You acknowledge that the installed products remain the property of SEA Connections until full payment is made.

4. Ownership of Products

Until the final payment is received, all goods and products installed by SEA Connections remain the property of SEA Connections. In the case of non-payment, SEA Connections may remove the products at any time, and you agree to provide reasonable access to allow us to do so.

Access for Removal: If non-payment occurs, SEA Connections reserves the right to enter the premises to recover any products or equipment we have installed, at the customer’s expense, if access is not voluntarily granted.

5. Warranty and Liability

Workmanship Warranty: SEA Connections offers a warranty for workmanship on all services provided. This warranty covers defects in workmanship but does not cover damage caused by misuse, neglect, or external factors like natural disasters.

Product Warranty: All products installed are covered by the manufacturer's warranty, and we will assist in facilitating any warranty claims for faulty goods as per the terms of the manufacturer’s warranty.

Exclusions: SEA Connections will not be liable for any indirect or consequential loss, including loss of profit, due to product failure or delays. We are not responsible for any pre-existing conditions on the property that may affect the installation, such as wiring or structural issues.

6. Right to Terminate

SEA Connections reserves the right to terminate any contract or service agreement at any time if payment terms are not adhered to or if the customer is in breach of any contractual obligations.

7. Customer Responsibilities

Access to Premises: The customer must provide access to the premises to allow SEA Connections to perform the agreed services.

Cooperation: The customer must ensure all necessary information is provided in a timely manner to ensure the successful completion of the project.

8. Force Majeure

SEA Connections will not be held liable for any delays or failures to perform due to causes beyond our reasonable control, including but not limited to acts of God, natural disasters, strikes, or government regulations.

9. Indemnification

The customer agrees to indemnify and hold SEA Connections harmless from any claims, damages, or liabilities arising from the customer’s actions, including but not limited to improper use of installed products, failure to maintain equipment, or any breach of these Terms and Conditions.

10. Intellectual Property

All intellectual property, including designs, plans, and project documentation created by SEA Connections, remains the property of SEA Connections. The customer may not reproduce, share, or distribute any intellectual property without prior written consent from SEA Connections.

11. Privacy and Data Protection

SEA Connections respects your privacy. All personal information provided to us will be handled in accordance with our Privacy Policy and Australian data protection laws. For further information on how we collect, use, and protect your data, please refer to our Privacy Policy.

12. Amendments to Terms

SEA Connections reserves the right to modify or amend these Terms and Conditions at any time. Any changes will be posted on this page, and the updated Terms and Conditions will be effective immediately upon posting.

13. Dispute Resolution

In the event of a dispute, we will first attempt to resolve the matter amicably. If an agreement cannot be reached, the dispute will be referred to a mediator or arbitrator as per Australian Consumer Law.

14. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the state of NSW, Australia. Any legal actions arising from these terms will be subject to the jurisdiction of the courts located in NSW.
